
The Louisiana Record reports a case in which a painter is suing a real estate company for injuries he incurred while painting. It reports:
“An independent contractor is suing a local subdivision over injuries he sustained on the job.
David Gayden filed suit against Westhaven LLC and Bilwood Smith Real Estate Incorporated in the 19th Judicial District Court.
According to court records, the plaintiff was hired as an independent contractor to paint one of the defendant’s properties located at 10167 Bonnet Cove Ave. in Baton Rouge. The plaintiff claims that while he was painting he fell through the balcony flooring where it was rotten.
The defendants are accused of knowing of this unsafe condition and failing to do anything about it, failing to warn the plaintiff of a hazardous condition, and failing to adequately inspect the property.
As a result of the accident, the plaintiff claims he suffered numerous injuries to his back, neck,ankle, and right arm.
An unspecified amount in damages is sought for body damages, medical expenses and court fees…”
