Pa. Sen. Wants To Stiffen Independent Contractor Law

From Law360 — “A Pennsylvania state senator on Tuesday announced that he had introduced legislation that would enable local district attorneys to investigate and prosecute employers that improperly categorize construction employees as independent contractors.

Sen. Mike Stack, D-Philadelphia, said that regulators from the state’s Department of Labor had fallen short in enforcing a 2011 law that narrowly defines independent contractors and makes companies and agents subject to civil penalties for violations.

“When it comes to protecting workers and taxpayers from employer manipulation, the state Department of Labor is not up to the job,” Stack said in a statement. “It’s time to give local law enforcement the tools to prosecute when they uncover violations of state labor law.”
