Employers Must Protect Employees from Third-Party Harassment

workplace harassment complaint form

From Lexology, Fiona W. Ong discusses a recent case in which an employee was able to proceed with a claim for a hostile work environment when the  employer (a facility for patients with severe mental, developmental, behavioral or physical disabilities) did not assist the employee when the employee was harassed by a third party (a patient).

This case offers a word of caution for companies that engage with independent contractors to make sure their employees are properly supported if an independent contractor harasses or otherwise creates a hositile work environment for employees.
