CPA Practice Advisor reports that drivers for GrubHub have started a class action lawsuit claiming that they were misclassified as independent contractors. The report states:
Drivers for the takeout food app GrubHub have filed a class-action lawsuit claiming the company misclassified them as independent contractors, thus paying them less than minimum wage and denying overtime pay.
GrubHub drivers provide their own cars, insurance and fuel, and they assume liability for on-the-job injuries. They deliver take-out food orders for a flat fee plus tips. The net take for many drivers, they claim, falls below applicable state or federal minimum wages.
GrubHub drivers allege they are employees because they must sign up for shifts in advance, meet a dress code and accept 75% of delivery jobs offered to them or else have their contracts terminated.
GrubHub attempted to have the class action thrown out in a federal court in California, but the judge refused that motion. The lawsuit represents drivers in six states: New York, plus California, Connecticut, Illinois, Oregon and Pennsylvania.

As a Grubhub delivery driver, I live in Oregon and would like contact information included in the class-action lawsuit against Grubhub and many other drivers. Grubhub has been misclassifying employees and not only paying them as little as $2.00 per order, but has recently flooded the app with low-paying offers with high miles for delivery. If you do not accept the low offers, you are penalized until you fall from premier driver, to pro, to partner, just to punish drivers for not wanting to go 17.9 miles for $7.58, or 4.5 miles for $2.15. This causes our stats to be so low that we are no longer eligible to pick our hours and must wait until all other drivers have taken all of the good blocks and only get a few blocks a day, leading us to a significant loss in income for at least a month to three months, until we can get our stats back up to Premier status. We must be classified as employees since we are treated as employees and penalized for everything, even for something beyond our control. I want Grubhub to pay mileage plus at least minimum wage pay going back to the day every Grubhub driver started working for Grubhub. Grubhub is doing this only because all illegal aliens working for Grubhub will accept any low offer, regardless of the mileage. After all, they do not have to rely on Grubhub to pay their bills since the American taxpayers are footing all the expenses of the illegal aliens living off of our hard work. You can spot all of the illegal aliens because they carry two phones while doing deliveries and do not speak any English. We need to sue these delivery apps out of existence if they do not start paying their drivers and deport every last illegal alien that is living in the USA.
